Description
The constitution guarantees basic rights and the possibility to invoke them before independent courts. But who actually determines what each basic right means? The Constitutional Court of the Czech Republic has been promoting for over two decades a doctrine according to which we have broadly understood basic rights, the true content of which is created only in judicial proceedings, where we defend them against restrictive laws. Economic, social, and cultural claims are among the only ones whose scope can be influenced by Parliament. The author challenges this doctrine and offers a reading of the Charter of Fundamental Rights and Freedoms that understands the democratic Parliament as an organ that is more often than the Constitutional Court legitimized to shape the content of our basic rights. Because the book raises questions that have not yet been posed in the Czech context, it is intended for a wide audience interested in law, politics, philosophy, and other social science fields.
