We are facing a difficult situation, the coronavirus pandemic. Prolonged legal issues, such as the fact that the Czech Republic has long-overcrowded prisons and the number of prisoners exceeds the European average, may now be even more serious for various reasons. The Criminal Code offers, in addition to imprisonment, a number of other types of penalties, so-called alternatives to prison. Why are they not used as often as would be desirable? What needs to be done for courts to more frequently impose monetary fines and send convicts to house arrest? And shouldn't we, at the beginning of the 21st century and in such an unprecedented moment, also consider whether we need entirely new penalties?
