Zákon o mezinárodním právu soukromém – Dobiáš Petr (2014)

Act No. 91/2012 Coll., on Private International Law, comes into effect on January 1, 2014, along with the new Civil Code, which it follows. The new law regulates issues that the previous law on private international law and procedural law did not explicitly address – for example, the qualification problem, circumvention of the law, and necessarily applicable provisions of legal regulations. However, some areas are not regulated at all or only partially by the new law because they are governed by directly applicable EU regulations (Regulations Rome I and II, Regulations Brussels I and IIa, Regulation on Maintenance Obligations, and Regulation on Inheritance). The commentary refers not only to national but also to relevant international and European regulations. A significant place in the text of the book is occupied by applicable case law, which is presented in its original wording, as well as significant decisions of the Court of Justice of the EU, which were translated specifically for this commentary in some cases. The book includes the current wording of the Instruction of the Ministry of Justice, which regulates legal assistance of judicial authorities in dealings with foreign countries in civil and commercial matters.
