Rekodifikace trestního práva procesního v letech 1948–1950 – Bláhová Ivana (2017)

The preparation of a new criminal procedure code is a current issue that criminal lawyers have been dealing with for the last twenty years. Efforts to recodify procedural criminal law have accompanied our legal system since the establishment of Czechoslovakia nearly a hundred years ago. This book offers an insight into one of the recodification phases, known as the legal biennium, which aimed at establishing the communist regime and introducing law corresponding to the principles of people's democracy. The core part is dedicated to a detailed description and analysis of the legislative work process and its outcomes. Through archival research, the book seeks to answer the question of whether it was possible to prepare a quality criminal code in such a short time, and in this context, whether it is possible to draw inspiration today from the organization of recodification work at that time. At the same time, the book provides an overview of the adopted legal regulation of criminal proceedings, which on one hand became the first unified legal regulation in Czechoslovak territory, but at the same time, along with the criminal code of 1950, allowed for the misuse of criminal regulations as a tool for political persecution.
