A quarter of a century since November 1989 is an opportunity not only to commemorate the anniversary of the Velvet Revolution and to look back at the history of the post-war years and communist rule, but also to assess the post-November development, including how society reacted to its totalitarian past and the injustices associated with it. The way in which democratic society defined itself in relation to the period of communist dictatorship and the events that preceded it has influenced not only the current form of the political and economic arrangement of the state but also the character of its constitutional and legal system. Complex cases of legal responses to the past, in which fundamentally incompatible normative systems of socialist and democratic law collided and were applied concurrently, contributed to a qualitative transformation of legal thinking and decision-making, stepping beyond the boundaries of written law. The presented book traces this transformation and addresses the fundamental areas of legal response to the past, including criminal proceedings, lustrations, and restitutions.
