This book examines contemporary international law-making within the United Nations, focusing on the respective roles of the Sixth Committee of the UN General Assembly and the International Law Commission in the progressive development and codification of international law. It combines a theoretical framework with insights from UN practice, explaining why a previously effective law-making process has stalled and what the resulting stagnation means for the future development and codification of international law. Attention is also given to the causes and consequences of the diminishing role of states, while the strengthening role of the International Law Commission and other bodies is critically assessed. The book is intended for academics and students, members of the diplomatic service, lawyers working for international organisations and anyone seeking to understand who effectively makes international law today, and whether it remains an autonomous legal system or is gradually becoming heteronomous.
