The book analyzes the functions of four key constitutional law constructs: dignity, equality, freedom, and justice, in legal argumentation. It helps illuminate how courts should (and should not) use these constructs in their arguments. Specifically, it uncovers some fundamental issues related to the hybridization and axiomatization of the functions of these constructs and suggests how to avoid or at least minimize their negative consequences for the quality, persuasiveness, logical coherence, and predictability of legal argumentation. The book is intended not only for legal scholars and theorists but also for legal practitioners, especially judges.
