The European Union represents one of the largest exporters and recipients of foreign investments. In light of this position, the year 2009, when the Lisbon Treaty came into force, which incorporated foreign direct investments into the common trade policy under the exclusive competence of the Union, marked the beginning of the emergence of a new significant global player in the creation of investment policies and international investment law. The initiation of negotiations with the United States on the Transatlantic Trade and Investment Partnership (TTIP) four years later sparked unexpected critical public interest, prompting the EU to reassess its approach and adopt the topic of reforming the investment protection system, which has faced a growing legitimacy crisis over the past decade. Thirteen years after the Lisbon Treaty came into force, it can be stated that the common investment policy is maturing and changing the system of international investment law. At the same time, however, it offers more questions than answers in many respects. The publication introduces readers to the issues of international investment law and subsequently to the specific context of the EU.
