The monograph presents the first comprehensive discussion of the criminal law institute of necessity in a historical and comparative context. It shows that necessity is not just a theoretical institute, but regulates situations that occur quite frequently in life. These include cases that are real challenges not only for lawyers, philosophers, or historians, but also for the general public. Opinions on how to address extreme (critical, dangerous, urgent) situations have evolved throughout human history, just as morality has evolved, as well as the understanding of the human soul and natural human reactions. States of emergency bring dilemmas, that is, situations requiring a choice, which is often burdensome. The difficulty of choice stems from the necessity to weigh certain values or interests. Although the possibility of choice complicates life for us Europeans, we should not forget that it is the foundation of our free thinking and ultimately of the democratic values cultivated in Western civilization for several centuries.
