Beschreibung
The third edition of a popular publication describes the most significant issues regarding the justification of written judgments that judicial practice faces and which are addressed by higher courts, including the Constitutional Court of the Czech Republic. It mainly concerns the complexity of justifying judgments and the predictability of court decisions. In the new edition, the author has added new case law and taken into account insights from current judicial decision-making practice. Where appropriate, case law from the Supreme Administrative Court of the Czech Republic is also cited, as well as, due to similarly regulated procedural provisions in some places, case law from the Supreme Court of the Slovak Republic or the Constitutional Court of the Slovak Republic. The conclusion of the publication contains examples of judgments, as well as a brief list of relevant adjudicated legal opinions, which will facilitate basic orientation in the issues of justifying written judgments in relation to the principle of a fair trial for the user of this guide. The work is intended for both law students as supplementary material in the study of procedural law, as well as judicial candidates or assistants to judges. Lawyers will also find useful information in it, as it provides a brief overview...
