The publication addresses the issue of the transfer of rights and obligations from employment relationships from the perspective of Czech labor law and the EU directive on transfer, highlighting a number of pitfalls in the legal regulation faced by both employers and employees. The author explains the rights and obligations of employees who are transferring to another employer, reminding employers of the obligations that arise in this regard. It focuses particularly on the significant changes in the regulation of the transfer of rights and obligations brought about by the amendment to the Labor Code No. 285/2020 Coll., effective from July 30, 2020, and January 1, 2021, and presents several practical cases. The publication also extensively addresses the legal regulation of the transfer of rights and obligations from employment relationships at the level of the European Union and in Great Britain, analyzing the relevant EU directives and applying several decisions of the Court of Justice of the EU to the conditions of employers in the Czech Republic.
