The scientific monograph brings new interesting perspectives on the fundamental concept of the specific legal institute of liability for defects in performance in sales contracts in commerce in the context of the latest legal regulation of the obligations of commercial entities. In terms of content, the publication examines and interprets selected theoretical works and legislative and application starting points of the chosen legal institute and places them in broader contexts, particularly emphasizing European Union law in relation to the trends of Europeanization of private (commercial) law. The findings are presented with regard to the current process of recodification of this legal field in the Slovak Republic. Thematically, the monograph focuses primarily on clarifying issues related to defective performance in contractual obligations, where the primary obligation for proper and timely performance has not been extinguished. The debtor falls into default, and the original commercial (obligatory) relationship transforms into a new dimension, the essence of which is liability for defects in performance, while the framework of the basic obligation remains quasi-preserved.
