Beschreibung
The publication deals with cases in which there is handling of someone else's property against the will of its owner. This includes both the connection of one thing with another (accession), the processing of someone else's property into another thing (specification), versio in rem, the use of someone else's property in averting extreme necessity, and finally the possibility of sacrificing someone else's property to save someone else's value. The author examines these cases in historical contexts and follows the ways in which damages incurred by the use of the property to its owner are compensated in individual legal regulations: from Roman law through pandect law, Austrian, Czechoslovak, to the Civil Code of 2012. At the same time, the author analyzes the extent to which the legal regulation of the mentioned cases in the current Civil Code reflects the principle that 'no one can enrich themselves at the expense of another' and whether the legal regulation of unjust enrichment can be applied to these cases.
