The General Data Protection Regulation, GDPR, is one of the most significant legislative achievements of recent years. It has become a global standard for data protection and also represents the first more comprehensive regulation of artificial intelligence. This second edition of the commentary responds to extensive decisions by supervisory authorities, particularly the adoption of Act No. 110/2019 Coll. on the Processing of Personal Data. The adaptation act brings Czech law into line with the GDPR and introduces specific national exemptions, for example for processing for journalistic purposes, academic, artistic or literary expression, and the imposition of fines on public authorities and public entities. It also separately regulates the processing of personal data in safeguarding the Czech Republic’s defence and security interests, an area entirely excluded from the GDPR, and implements Directive 2016/680 on protecting individuals in connection with the processing of personal data by competent authorities for the prevention, investigation, detection and prosecution of criminal offences or the execution of penalties. Compiled by a team of authors led by experienced lawyers with many years of practice in data protection and information technology law, the commentary aims to present the subject not only theoretically but especially in practical terms, with concrete examples where appropriate. The publication offers a comprehensive insight into the complex legal field of personal data protection, whose importance in today’s digital age will continue to grow alongside the rapid development of new technologies.
