Personal rights consist of individual rights that are protected by both private and public law. The significance of their protection increases in proportion to the real and potential threats posed by the mass use of modern communication technologies. Special emphasis is placed on the protection of privacy as one of the fundamental human rights. The publication discusses the protection of personality, privacy, and personal data in constitutional and EU law (GDPR), including its adaptation in the Czech legal system, the general regulation contained in the Civil Code, and in several specific areas such as banking and payment transactions, the provision of healthcare with an emphasis on the importance of informed consent, and a special chapter is dedicated to the issue of protecting these rights in cyberspace. The authors also address the proving and establishing of identity in private law relationships as well as in contact with public authorities. In the final chapter, they focus on the criminal law protection of privacy. This practical guide is intended not only for professionals but for anyone who may come into contact with the protection of personality and privacy in their professional or everyday life.
