Obchodní podmínky v mezinárodním obchodním styku – Dobiáš Petr (2019)

The authors analyze the norms of international private law related to the issue of general terms and conditions, as well as aspects of potential dispute resolution arising from private legal relationships with an international element. Disputed aspects may arise during contract formation, the use of terms and conditions, their proper incorporation into private legal relationships, and in distinguishing situations related to the conduct of business between entrepreneurs and the participation of consumers in international private legal relationships. General terms and conditions may regulate the choice of law or the choice of method for resolving potential disputes, whether through international commercial arbitration or the implementation of a prorogation agreement, among other issues. General terms and conditions are closely linked to the issues of individual types of contracts associated with the realization of international business relationships, from international transport to international construction and insurance regimes. The authors detail the criteria that must be met for the terms and conditions to be a functional part of legal relationships, particularly for similarly structured contracts.
