Beschreibung

The land regulations represented the basic land code, which contained not only private noble law but also a number of key provisions concerning public law, the organization of the land, and security issues. The commentary provides a fundamental discussion of the individual institutes of land law contained in these collections. The subject matter of the commentary is divided into two volumes, with a natural boundary being the provision that opens a series of regulations dealing with the special competencies of the land governor in the area of judiciary and procedural proceedings in non-contentious matters. The starting text for the commentary was chosen as the last pre-Battle of White Mountain regulation from 1604, which is based on the Znojmo land regulation from 1535, or its edition from 1562, with the new regulation supplemented by a number of articles and some of the original texts corrected. Temporally, the commentary is anchored in the 'long' 16th century, i.e., roughly from the last third of the 15th century to the end of the Estates' Revolt in 1620, when there was a significant change in state legal relations that influenced the material contained in the Moravian land regulations in many respects.
