Beschreibung
The historically first direct presidential election in 2013 stirred unusual emotions among both the general public and experts in the Czech context, leaving a noticeable division in society that persists to this day. The causes of the less-than-ideal course of the election can be traced to several factors. One of them is the fact that during the election, a number of shortcomings in the existing legal framework (particularly Act No. 275/2012 Coll., on the election of the President of the Republic) became apparent, which were the subject of complaints to the Supreme Administrative Court and the Constitutional Court. The areas that proved to be problematic included the candidate nomination process, campaign financing, and, not least, the ethical dimension of the campaign. The aim of this publication is to describe both the shortcomings that were already evident during the 2013 election and the areas that are potentially risky for the future. It is also important to attempt to debunk some falsehoods and myths that have been voiced regarding the legal framework, particularly by unsuccessful candidates. At the same time, the book proposes specific solutions that could rectify the current unsatisfactory state. An important source of inspiration in this regard is the comparison of the Czech regulation with those of EU member states.
