Beschreibung
The presented book critically examines the theories of leading legal philosopher Robert Alexy. As the majority of the legal academic world agrees, Alexy's theories represent not only a fundamental and classic work of German constitutional theory but also a theory that has significantly contributed to the development of a normatively grounded, post-positivist understanding and analysis of constitutional legal systems. Alexy's theories are a foundational building block for any serious discussion about constitutional rights as well as debates on the development of constitutional law and legal argumentation in general. This publication addresses not only theoretical, ethical, and political topics but also focuses on practical questions of legal interpretation. The questions posed by the authors of this book concern both the definition and conception of constitutional, human, and fundamental rights, as well as Alexy's attempt to define the structure and content of constitutional rights and his efforts to establish the limits and scope of fundamental rights.
