Description
This expert study offers an impartial and critically detached assessment of whether the new legal regulation of rape meets the needs of contemporary society and contributes to more effective protection for victims of sexual violence. It emphasises that the law should primarily protect the weaker and vulnerable, while also respecting the principles of a fair trial and legal certainty. The book discusses the redefinition of rape, the development of its legal regulation, its basis in international law, and the offence under Section 185 of the Criminal Code. It analyses the definition of rape based on the absence of consent to sexual intercourse, presents an overview of related court decisions, compares selected international frameworks with the regulation under Section 185, and provides a statistical analysis of data connected with the redefinition of rape. The study concludes with recommendations and a reflection on the redefinition of rape.
