Description
The interpretation of law is an integral part of the functioning mechanism of law. Interpretation becomes even more challenging when the subject matter is as ancient as the law in the Digests, the code of Emperor Justinian from 533. This text is a compilation of excerpts from hundreds of works by several dozen authors living over a span of three hundred years. The chapters forming this book focus on various areas of Roman law. It includes an analysis of the term familia, which usually denotes family, but not only that. Furthermore, the reader will find issues briefly referred to as fructus sine usu, which pertains to acquiring the fruits of a thing to which the acquirer has no right of use, and questions regarding the relationship of testamentary succession and intestate succession. The final chapter is from the area of Roman criminal law and is dedicated to a specific crime known as crimen falsi. As a whole, the book aims to illustrate the pitfalls that a lawyer studying Roman law contained in Justinian's Digests must face.
