The Civil Code of 2012 is, in a way, a return to tradition. After two previous civil codes from 1950 and 1964, whose content was based on popular-democratic and socialist ideological foundations, the new civil code turns back to the roots of Czech private law. These roots are historically linked primarily to the Austrian General Civil Code of 1811, whose content, however, stemmed from a broader tradition of continental legal culture – from Roman law. In the presented book, a collective of legal Romanists examines the actual extent of the influence of Roman law on the latest Czech private law code, specifically on its part dedicated to property rights. In brief comments, the authors compare individual provisions of the new Czech Civil Code with Roman law from the period of the 1st century BC to the 3rd century AD. They add translations of original sources to their interpretations, which document the similarities or differences compared to Roman law. They thus show that despite the significant time gap and technological and social progress, the legacy of Roman law, one of the pillars of European legal culture, is still alive and offers potential for legislation, as well as for application and interpretation today...
