Preventivní restrukturalizace - Nová etapa koncepce sanačních procesů a její implementace do českého právního řádu – Schönfeld Jaroslav (2021)

The book "Preventive Restructuring" offers the most extensive and profound interpretation of the new direction of European legislation and, generally, European economic and legal thinking in the area of managing financial difficulties of companies through restructuring procedures in the Czech legal and economic environment. Since 2019, there has been a European directive on restructuring and insolvency, which was supposed to be incorporated into national legal systems by July 2021; however, the Czech Republic did not meet the deadline. Nevertheless, this publication shows that the delay is not related to the fact that the professional community has not sufficiently considered the issues of preventive restructuring and corporate rehabilitation. In addition to the interpretation of the European directive and analyses of possible rehabilitation solutions, the book also provides a number of very specific proposals for implementing the European directive into Czech law. The publication, based on numerous analyses and a wealth of unique data from research, demonstrates that the intensive examination of this intersection of legal and economic science has advanced our domestic thinking in this area to the forefront of the European and global peloton.
