Description
The monograph deals with current trends in labor law, particularly new forms of employment based on the so-called gig economy. The gig economy, or on-demand economy, represents short-term (occasional or irregular) work on projects and contracts in sectors such as IT, financial services, construction design, media, marketing, transportation, or sales, usually provided through an online platform. It is one of the further developmental stages of work realization, where it is necessary to examine in detail the conditions under which the work or service is provided.
Special attention is paid to the legal status of gig workers. This is related to questions concerning the defining characteristics of dependent work.
The publication further focuses on Directive 2024/2831 on improving working conditions in platform work, which regulates algorithmic processes of work organization, establishes a presumption of the existence of an employment relationship, and guarantees adequate working conditions for individuals performing work through a platform. The Czech Republic is required to transpose the directive by December 2, 2026.
