Description

The monograph deals with selected principles of criminal proceedings in the context of a fair criminal process, which is the central theme of the entire publication. The authors aimed to select those principles that have a significant impact on the realization of justice in criminal proceedings and are therefore the most interesting for the reader. The first chapter contains a discussion on the principle of adversarial proceedings as a pillar of a fair criminal process. The second chapter addresses the principle of nemo tenetur se ipsum accusare ("the prohibition of coercion to self-incrimination" or "no one is obliged to accuse themselves"). The third chapter contains a discussion on the principle of presumption of innocence and its application in practice. In addition to the theoretical foundation, the authors also process case law from both national and international sources. The monograph will appeal primarily to the professional public, whether among practicing lawyers (investigators, judges, prosecutors, attorneys) or lawyers from the academic sphere, but due to its content and interpretation, it will also be understandable to anyone involved in the course of criminal proceedings in our country.
