The operation of autonomous vehicles, which will undoubtedly one day drive on our roads, raises a number of legal questions. One of the most pressing issues is the problem of liability for damages. Currently, the vast majority of accidents are caused by human error; in autonomous vehicles, the most common cause of accidents will be technical failure. While partially autonomous vehicles will still have a driver present, fully autonomous vehicles will be controlled solely by autonomous driving systems. Many different entities will be involved in autonomous driving, whose products, services, or data could potentially cause damage. It will not be uncommon for damage to arise from an autonomous decision made by the control systems, or from damage resulting from a combination of various causes. The publication focuses not only on liability under the provisions of the Civil Code that would be applicable in the event of damage, but also on the individual entities that could be liable for damages, analyzing their liability from the perspective of civil law. The authors identify shortcomings in the current legal framework and propose possible solutions.
