The monograph deals with the issue of financial institution failure and the necessity of addressing it in such a way that the impacts on financial stability are minimal, the institution's insolvency does not have negative effects on the real economy, and public funds are not needed to rescue the institution. It systematically presents Directive 2014/59/EU, which establishes a framework for recovery procedures and the resolution of crises in credit institutions and investment firms, also known as the Bank Recovery and Resolution Directive (BRRD). The work also includes the first major amendment to this directive, which regulates the ability of credit institutions and investment firms to absorb losses and their recapitalization capabilities (BRRD2). The aim of this book is to encompass the main objectives and principles of the directive as well as the reasons why it was necessary to introduce a special and uniform regime for the resolution of financial institution crises within the EU, as well as the reasons why their liquidation in the usual manner is not always a viable solution. The book is intended for both financial market experts, who can learn more about this specific area of financial law, and the broader professional public, who will gain a basic overview of the extensive regulation of financial institutions within the EU and its development.
