Description
This book examines the influence of judicial philosophy on court decisions in complex cases involving the application of law. It shows how differing views of the principles of legal interpretation, the role of the judiciary in the constitutional system and the function of law determine methods of judicial decision-making, dividing judges into legal formalists, legal pragmatists and legal substantialists. Using a case study of decisions by the extended senate of the Supreme Administrative Court, the author examines the ways judicial philosophy appears in the separate opinions of its individual members and identifies the main reasons for disagreement in controversial cases. The theoretical section demonstrates Kristina Blažková’s excellent grasp of legal theory and her ability to connect theoretical findings with legal practice and previous, particularly international, research. A chapter portraying the judicial philosophies of the extended senate’s members offers valuable insight into the work and decision-making of the Supreme Administrative Court. The book is described as an important and pioneering contribution to an interesting and highly topical field.
