Description
This publication examines the legal and non-legal factors that influence the decision-making of the Constitutional Court of the Czech Republic. It focuses chiefly on how the external political and social environment shapes the conditions for the court’s decisions, how the differing views and approaches of individual judges are reflected in this decision-making, and how the composition of judicial panels affects it. Drawing on empirical methods, the author shows that the court’s work strongly reflects differences between individual judicial personalities, particularly between activist and restrained approaches to judging.
