Description
Protective treatment and security detention are among the protective measures that can be imposed on perpetrators of criminal or otherwise punishable offenses in criminal proceedings. The monograph thoroughly analyzes the current legal regulation of protective treatment in both outpatient and institutional forms, as well as security detention. It also examines the decisions of general courts with regard to the case law of the Constitutional Court and the European Court of Human Rights. The author processes statistical data from the Ministry of Justice of the Czech Republic and the Czech Prison Service, her own expert research in the Remand Prison and the Institute for the Execution of Security Detention in Brno, as well as her own professional experiences. The book also provides insight into the legal regulation of the affected institutions in some European countries and the USA. The conducted research reveals many suggestions de lege ferenda, such as the necessity for a unified registry of individuals undergoing protective treatment.
