Pre-trial detention is a traditional institution of procedural criminal law. It represents a procedural institution that significantly interferes with the personal freedom of the accused, with this interference occurring at a time when their guilt has not yet been decided. Pre-trial detention is thus enforced against a person who is presumed innocent. The monograph addresses the issue of respecting the exceptional nature of imposing pre-trial detention as a measure of ultima ratio, not only from the perspective of the statutory regulation of the conditions for its imposition but also from the perspective of the application practice. It examines the institution of pre-trial detention and its legal regulation in the Czech Criminal Procedure Code through the lens of international standards and requirements arising from the principle of a fair trial. It points out problematic aspects of the current Czech legal regulation and contemplates whether and to what extent legislative changes are necessary.
