Description
The monograph presents the institute of donation with a command according to Roman law. It analyzes donations accompanied by an obligation imposed on the donee, which need not consist solely in a specific use of the donated item (it does not have to be just a purpose designation), but could also have a broader intention, and its fulfillment could be in the interest of the donor or a third party. The author seeks to answer questions that are equally relevant in modern civil law: Is a donation with a command still a donation or already a mixed, or exclusively onerous legal act? What claim arose for the donor, or respectively the third party, from the command? What is the difference between a donation with a command and negotium mixtum cum donatione, or what is the relationship between the non-fulfillment of the command and the ingratitude of the donee?
