Description
The publication addresses the issue of the process of preparing government draft laws in the Czech Republic, with its interpretation set within both a theoretical framework formed by a 'newly' proposed theory of legislation in the Czech Republic and, of course, the environment of long-term practice. The importance of this process is primarily given by the dominance of the government among the entities endowed with legislative initiative, that is, the authority to prepare and submit draft laws for discussion in Parliament. In this regard, it is all the more alarming that this issue is largely neglected in our country from both theoretical and practical perspectives (including legal regulation). Therefore, this publication aims to fill this gap, bringing findings that the examined process suffers from a number of fundamental (conceptual, systemic) deficiencies, which ultimately affect the quality of adopted legal regulations and legislation in general.
