Description
The main goal of this book is to analyze the philosophical movement within Anglo-American legal science, most commonly referred to as the 'new theory of natural law.' This term denotes a specific revival and reworking of Thomas Aquinas's theory of natural law initiated in the 1960s by the Franco-American philosopher Germain Grisez. Grisez's main collaborator was the Australian legal philosopher John Finnis. In his book Natural Law and Natural Rights, Finnis attempted to reformulate the natural law doctrine with the intention of countering the most common objections from opponents. This major work of his is often regarded as a significant contribution to the debate between positivists and proponents of natural law. The new theory of natural law employs arguments corresponding to modern legal-philosophical debate and seeks to find original answers to questions of human good and practical reason. Therefore, its conception can be considered a significant contribution to the renaissance of natural law thinking in the 20th century.
