Human dignity is a value with many faces that emerges in an almost unlimited number of diverse situations, ranging from ordinary slander to the torture of human beings in extermination camps. However, this ultimately leads to vagueness in its content and the associated interpretative problems. This book therefore offers a new conceptualization of the value of human dignity in law based on its functional analysis, distinguishing dignity as an independent human right, an objective constitutional value, and finally a source of human rights. The book also provides a critical reflection on the current use of human dignity in constitutional law, with its focal point being the rejection of axiomatic dignitarian arguments as argumentative fouls that degrade the quality and rationality of judicial reasoning and, consequently, reduce the level of legal certainty.
