Description
The resolution of cross-border disputes increasingly occupies lawyers from various legal fields, even at the stage of establishing legal relationships, when parties seek to agree on the most efficient way to resolve any potential disputes that may arise in the future. Therefore, contracts typically include not only arbitration clauses but also mediation and prorogation clauses. However, although the provisions in the contract usually appear inconspicuous and contain at most a few paragraphs, they become cornerstones for resolving the dispute or achieving a successful resolution once a dispute arises. The publication aims not only to analyze current issues related to clauses for resolving cross-border disputes encountered in the Czech legal environment but also to compare the solutions adopted by Czech courts and the professional community with foreign legal practices. Given that the legal regulation of clauses for resolving cross-border disputes exists in both national and EU norms as well as international origins, the publication represents a compilation of various approaches and theories that influence this rapidly evolving legal area.
