Ochrana osobnosti v pracovněprávních vztazích – Zahradníček Jaroslav (2019)

The publication addresses the current topic of personality protection and personal data in employment relationships. The rapid development of information technology and the related automation of workplace processes allow for easy monitoring of employee performance, tracking when they take breaks and how they spend them, how they collaborate with other employees, or how they use entrusted resources. The recent popularity of the topic has also been fueled by the new personal data protection regulation under the General Data Protection Regulation (GDPR). In the first part, the author discusses the legal framework and sources of the analyzed issues, and further describes the general premises for examining personality protection. The second part focuses on the protection of employees' personality and privacy, including an analysis of relevant case law. It concentrates on the specifics of relationships between employees and employers, the protection of employees before and after the termination of employment, and the possibilities of monitoring employees.
