Description
The method (test) of proportionality currently represents a fundamental methodological approach to reviewing the constitutionality of restrictions on fundamental rights, which is applied by courts around the world. This doctrine also significantly shapes the way we think about fundamental rights, how we talk about them, and how we argue with them in specific cases. The monograph maps the development of this fundamental constitutional law doctrine and its various variations and components in the practice of the Constitutional Court of the Czech Republic. It also provides guidance on how to grasp and properly work with this tool for applying fundamental rights. It is therefore intended for both academics and practitioners in the legal field, as well as students interested in public law.
