The practical course in legal methodology is primarily intended for law school students to develop legal thinking, which will one day distinguish them from non-lawyers, as well as to practice interpretative and argumentative skills and abilities. The practical course focuses exclusively on the methodological aspects of law - such as interpretative methods, resolving conflicts of legal norms, and conflicts of legal principles, including the application of proportionality tests, along with an outline of the methodology of legal comparativism. Each chapter includes a shorter theoretical introduction to the issues, which does not aim to provide exhaustive definitions but rather to awaken questions, study and research curiosity, and point out the interconnections of methods. All interpretative methods and arguments are closely related and intertwined. Nevertheless, from a didactic perspective, the topics are always focused on a specific method or issue. Each chapter includes exercises and case studies based on the fundamental case law of the Constitutional Court of the Czech Republic, the Supreme Administrative Court, the Supreme Court of the Czech Republic, the European Court of Human Rights, the Court of Justice of the European Union, and also from cases handled by the Public Defender of Rights.
