Description
The new Offense Procedure Act (Act No. 250/2016 Coll.) is characterized by a departure from the traditional concept of administrative punishment as a purely administrative procedure, where the legislator newly incorporates traditional criminal law institutes into administrative punishment. At the same time, the new legal regulation records a significant formalization of administrative punishment in procedural terms. This brings increased demands on the expertise of officials who will apply the new regulation. The new commentary provides practical guides for procedures under the new Offense Procedure Act based on the authors' previous practice. The interpretation of each provision is clearly divided according to individual institutes. The commentary is supplemented by an explanatory report and an overview of applicable administrative case law. The commentary is primarily intended for authorized officials who will decide on offenses.
