The publication is a comprehensive treatment of the issues surrounding fundamental, or human rights. After an introduction to the theory of fundamental rights, including questions related to terminology, the origins of these rights, their content-specific characteristics, forms of influence, and the subjects entitled and obligated, the work further addresses the interpretative and applicative specifics of fundamental rights, particularly issues related to the limitation of these rights and the standards for reviewing any restrictions. Space is also devoted to the legal grounding in positive law and the related enforceability of fundamental rights, as well as the national, international, and European mechanisms of legal protection. Special attention is given to constitutional complaints and complaints to the European Court of Human Rights. In the subsequent sections, the work thoroughly and systematically addresses individual fundamental rights, starting with the general prohibition of discrimination and the rights of national minorities, through various personal, political, economic, and social rights, to the right to legal protection (fair trial). The book will serve both as a teaching aid and as a practical guide for anyone encountering the issues of fundamental rights, especially in their professional practice.
