The practical guide addresses the rights and obligations of neighbors according to the new Civil Code, which regulates neighborly relations in more detail and in many respects differently than the old Civil Code. The book also serves as a guide to property rights, primarily ownership rights and servitudes. It thoroughly analyzes the legal relationships between neighbors, the legal grounds for the use of real estate, and the statutory ways to protect neighborly rights, including all types of lawsuits permitted by the new Civil Code. The guide describes, for example, civil law issues related to buildings, wells, ponds, roads, entry onto another's land, the undergrowth of tree roots, overhangs onto neighboring land, the intrusion of domestic animals, noise, smoke, or other nuisances and servitudes. The issue of disturbing neighbors through nuisances is also discussed from the perspective of public law. Attention is also given to the question of boundaries between properties. The work addresses problems that arise or may arise in practice and explains how the law and the applicable judicial case law resolve them. The authors are judges, but their book is intended not only for judges, lawyers, and other legal professionals but also for the general neighboring public.
