Description
The main purpose of the proposed amendment is to eliminate the shortcomings of transposition pointed out to the Czech Republic by the European Commission in the Reasoned Opinion - Violation of the Treaty No. 2018/2271. Furthermore, it clarifies certain provisions of the law; however, the amendment does not introduce new rights and obligations that would have significant economic impacts. In addition to eliminating the shortcomings of the transposition of European procurement directives, the proposal makes changes that will lead to a reduction in administrative burdens on both contracting authorities and suppliers, removes the undue strictness of certain rules, clarifies interpretative ambiguities, and last but not least, also eliminates legislative and technical deficiencies in the text of the Law. However, these are not fundamental conceptual changes to the procurement process.
