Description
The purpose of the Civil Code is to summarize the main body of legal rules relating to private legal matters that are common to all individuals. From the perspective of basic systematics, the Civil Code is divided into five main parts: 1. general part, 2. family law, 3. absolute property rights, 4. relative property rights, 5. common, transitional, and final provisions. The general part is dedicated to the issues of the legal status of a person as an individual, including the regulation of rights that are exclusively and naturally associated with that person. The second part of the Civil Code addresses questions related to family and family relationships. It includes legal rules governing marriage (its formation, the duties and rights of spouses, dissolution), kinship (its concept and types, relationships between parents and children, including the determination of parentage and adoption), guardianship, and other forms of child care (especially custody, placement of a child in care, and foster care). The subject of regulation in the third part is a person's property and the fate of that property after their death. The continuation of the Civil Code was published in Advisor 2/2024 and includes the fourth and fifth parts. The commentary on it was prepared by JUDr. Zbyněk Pražák.
