This selection contains Jürgen Habermas’s studies and supplementary texts on his discursive political and legal theory of the democratic constitutional state, which he developed systematically in his monumental book Between Facts and Norms: Contributions to a Discourse Theory of Law and the Democratic Constitutional State (1991). This is the second magnum opus of the mature Habermas in the field of practical philosophy, following in a highly complex way his equally monumental earlier work The Theory of Communicative Action (1981). Habermas’s attempt to provide a discursive foundation for liberal democracy forms an organic part of traditional debates in German political and legal theory, demonstrates a systematic engagement with Anglo-American discussions, builds in a complex manner on earlier stages of his thought, and gives entirely new expression to his fundamental intentions.
