Descripción

This Czech-language practical guide examines the key problems involved in giving reasons for written civil judgments, as encountered in court practice and addressed by higher courts, including the Constitutional Court of the Czech Republic. It focuses chiefly on the complexity of judgments’ reasoning and the predictability of judicial decisions. The fourth edition incorporates new case law and insights from current judicial practice, including, where relevant, decisions of the Supreme Administrative Court of the Czech Republic and, given similarities in procedural regulation, the Supreme Court and Constitutional Court of the Slovak Republic. It newly addresses appellate cassation decisions in relation to the trial court’s decision-making in subsequent proceedings. The author also draws on insights gained through an MBA in management psychology, considering the behaviour of judges, parties to proceedings and their representatives in the courtroom. The conclusion includes sample judgments and a concise overview of relevant legal opinions, helping readers orient themselves in the reasoning of written judgments in relation to the principle of a fair trial. The book is intended for law students, judges’ assistants preparing for judicial office and lawyers, who may find its overview of problematic aspects of the justice system useful when choosing litigation strategies, especially when representing clients in trial proceedings and drafting appeals, cassation appeals or constitutional complaints.
